
The 150-year debate to maintain, amend, or repeal the US Constitution’s 14th Amendment’s Citizenship Clause.

A few weeks ago, the US Supreme Court overturned President Trump’s executive order restricting birthright citizenship, which he signed last year after taking office for a second term. President Trump has indicated that he would “immediately” ask the US Supreme Court to rehear this case. Since taking office, President Trump has consistently stated that he intends to issue an executive order to end birthright citizenship in the US. A 150-year-old debate has been ignited by his desire to end the country’s unrestricted offer of jus soli citizenship. The debate is whether the Citizenship Clause enshrined in the 14th Amendment of the US Constitution should be amended, repealed, or maintained. Therefore, the arguments put forth by the two opposing sides in this debate are examined in this presentation.
